Guide and File

By clicking the “Guide and File” box below, you can finalize a divorce. The interview will produce two (2) different forms that will need to be filed separately. Please follow the filing instructions below for each one.

You are not legally divorced until both the Decision Pending Entry of Final Judgment and the Final Judgment forms have been filed with the court and signed by a judicial officer.

Filing Form #1: Decision Pending Entry of Final Judgment

The form titled “Decision Pending Entry of Final Judgment” must be filed with the court within thirty (30) days of the date of decision (the court date when the judicial officer granted the divorce).

Filing Form #2: Final Judgment

The form titled “Final Judgment” cannot be filed until three (3) months after the decision date. Please keep this form in a safe place until the three (3) month waiting period has expired and then file your “Final Judgment” form with the court.

If the Final Judgment is not entered within two hundred seventy (270) days from the date of decision, Final Judgment may be entered by written consent of the attorneys or parties. If the parties do not consent, a motion to enter the Final Judgment out of time will be required.

Please print your documents and file with the clerk’s office by mailing to the appropriate clerk’s office at the address listed below. You may also email your documents to the virtual clerk’s office at virtualfamilyclerk@courts.ri.gov or file your documents electronically.
