seeking review of an administrative
decision, pursuant to G.L. 1956 § 42-35-16,
must do so by filing a petition for a writ
of certiorari.
The petitioner, having filed a notice of
appeal, is not appropriately before the
Supreme Court.
Consequently, the plaintiff’s appeal from a
Superior Court decision dismissing his
administrative appeal is denied and
dismissed.

This is an
appeal from a summary judgment of the
Superior Court dismissing the claim of the
plaintiff for money damages as compensation
for drainage problems allegedly occasioned
by the negligent paving of his street.
Because the claim was filed more than three
years after the cause of action accrued,
suit is barred by the applicable statute of
limitations for claims against a municipality, G.L. 1956 §
9-1-25.
Judgment in favor of the defendant is
affirmed.
