The defendant appeals from a judgment of conviction for simple assault and disorderly conduct for charges stemming from execution by the state police of a search warrant executed on the Narragansett Indian’s smoke shop. The defendant contends that the trial judge erred in refusing to hold a post-trial evidentiary hearing to determine if the jury was racially biased, erred by refusing to permit the entire 15-member jury panel to deliberate, and erred by refusing to instruct the jury that the aggressive action of the state police in initiating a raid could constitute a defense to the charge of disorderly conduct.
